I thought the altitude restriction was based on the launch point? Like if you start at sea level and climb a 500’ hill, your drone might get ‘stuck’ at 400’ ASL, even if you’re above it on foot. If you start at the top of the hill, it could technically go higher. Not sure if this applies to your situation, though.

I tested mine, set high on purpose, and hit around 425 feet before getting a max altitude warning. I think the FAA’s 400-foot limit has a slight tolerance, like with airplane altitudes based on barometric pressure.
No issues with mine, I’m still able to go above 400.
